Extending H1-B Status at IUPUI
If an employee is already in H-1B status at IUPUI, complete the Request to process H1B petition (Hiring unit liaison, pages 1-3; Employee, page 4) and forward to International Affairs.
For H1B extensions, the following documents must be submitted to OIA to complete the extension petition:
- Check payable to DHS in the amount of $320.
See H1B Fee Information Please note the department must supply a paper check. OIA cannot produce a check from the department account.
- Letter from employer addressed to the US Citizenship and Immigration Services describing:
- the employee's current job title
- duties
- hours of work
- salary
- an indication of whether any terms and conditions of the original petition have changed. Please include a sentence: “There have been no changes in the duties or responsibilities since the last H1-B petition” if applicable.
- new dates of employment requested (three-year maximum).
- Updated curriculum vitae.
- Indiana State License if a license is required for the profession in the State of Indiana.
- Copies of I-94s (front and back) of employee.
- Copy of passport including biographical information and expiration date.
- Copies of all previous H-1B approval notices (Form I-797).
Additional Extension Information
- H1-B status can be extended up to a total of six years. However, because of the Labor Condition Application (LCA) requirements, requests for extension are processed in periods of not more than three years.
- Employees with employment-based permanent resident petitions filed by the end of the 5th year of H1-B status may continue to extend their H status beyond six years.
- An H-1B employee can continue employment at IUPUI even after the expiration of the prior H-1B approval, provided that OIA has verified that the extension request for the same employment has been received by the USCIS. However, travel outside the US without a valid H-1B Approval Notice is not possible; therefore, we recommend that extensions be initiated at least four months before the current H-1B status expires.
If the employee has dependents who also require an extension of stay, also provide all documents listed on the
Dependents Page.
