Ng called the meeting to
order at 3:30pm.
Agenda Item II: Adoption of the Order of Business for the Day.
The order of business for the
day was slightly revised to accommodate certain schedules and then was adopted.
Agenda Item III: [ACTION ITEM] Election of FC Officers for 2004-06:
Dolores Hoyt (Nominating Committee Chair, 4-0474, dhoyt@iupui.edu).
Hoyt distributed the ballots for the election of new FC
executive officers for the 2004-06 term.
She and her committee tallied the ballots and announced the results: Bart Ng will serve as FC President and
Rosalie Vermette as Vice President for 2004-06.
Hoyt thanked all of the candidates and then moved that the ballots be
destroyed. The motion carried.
Agenda Item IV: [FIRST READING] Presentation of Slates for Election to
the FC Executive Committee and Nominating Committee [the election will be conducted at the May 4 FC]: Dolores Hoyt.
Hoyt read the slate of candidates for the May 2004
election of the Faculty Council Executive and Nominating Committees (respectively)
for the 2004-06 term.
At the May 4, 2004 Faculty Council meeting, you will
be asked to vote for up to four of the following six candidates listed below. Official ballots will be
distributed and then tallied at the May meeting. The four individuals receiving
the most votes will serve a two year
term (7/1/04-6/30/06), joining these four individuals who will continue serving
until 6/30/05 : Anne Belcher (Nursing); B.
Keith Moore (Dentistry); Charles
Yokomoto (E/T); and Jim Baldwin (University Library).
The following four members are serving terms that expire this June
(2004): Karen Gable (Allied Health); Rosalie Vermette (Liberal Arts); Marion Wagner (Social Work); and Jeffrey Watt (Science). All

Agenda Item V: [INFORMATION ITEM] Election Results: 2004-06
Representatives At-Large to the FC: Dolores Hoyt.
Throughout the month of March
new Representatives At-Large to the FC were elected for 2004-06 via a ballot
distributed to all voting faculty. The
election had a very successful level of return (11% higher than in 2003). Hoyt thanked all the candidates and announced
the At-Large Election results, which were as follows (in alpha order):

Agenda Item VI: [ACTION ITEM] Research Professorship Proposal:
Christian Kloesel (Chair – Faculty Affairs Committee, 4-2003, ckloesel@iupui.edu).
Kloesel presented the Research Professorship Proposal [to
create a Research Professor series of ranks within the
Agenda Item VII: [ACTION
ITEM] Proposed Amendments to the FC
Constitution & Bylaws: Jennifer Hehman (Chair –
Bylaws Committee, 4-0488, jhehman@iupui.edu).
Hehman gave the second reading of proposed
revisions/amendments to the Faculty Council Constitution and Bylaws pertaining
to the service of the immediate past president as an ex-officio non-voting
member of the Executive Committee and Council (serving in an advisory
capacity). The proposal was initiated by
the Nominating Committee in the interest of promoting continuity and enhancing
the institutional memory resources for incoming presidents. The proposal was then reviewed and approved
by the Executive Committee, who requested that amendments be made.
“Bylaws:
Section A. President
1.....
6. At the end of the elected
term, the President shall normally serve as the Immediate Past President for
one year.
Section E. Immediate Past
President.
The Immediate Past President
shall:
1. Serve as an advisor to the newly
elected Presiding Officer.
2. Serve as a resource to
faculty committees, at their request.
3.Normally serve as an ex
officio non-voting member of the Executive Committee for one year.”
The FC then voted on the
motion to approve this amendment to the bylaws contingent upon the adoption of
the [associated] Constitutional amendment, which will be pursued via a ballot
of all voting faculty. The amendments to
the bylaws were approved by a 2/3 majority of voting FC members in attendance.
Agenda Items VIII: [ACTION ITEM] Revisions to the Student
Code of Conduct: Robert Yost (Chair – Student Affairs Committee, 8-1147, ryost@iupui.edu).
Yost updated the Council on
the status of revisions being made to the Code of Conduct. It has been determined by the UFC Student
Affairs Committee that the entire code will be rewritten over the coming year;
the process will begin in summer 2004.
In the interim, a temporary code has been developed to answer the most
immediate needs of students, service providers, and administrators. It so followed that Yost moved that the FC
endorse the following resolution:
“Resolution:
A shorter and more simplified Code will assist students, faculty and administrators in understanding and upholding the shared values of members of the university community. The University Faculty Council:
1: calls on members of the academic community from every campus, including faculty, students and administration, to work with the UFC Student Affairs subcommittee to rewrite the code as outlined in the preamble.
2: directs that this work begin as a working retreat during the summer of 2004 and supports making funds available for this retreat. This work will result in a Code brought before the UFC for adoption by the end of the 2005 spring semester.
3: supports the development of Code sections on core values, definitions, and behavioral expectations (currently sections I, III, and V) as a document that can be used as a system wide code, and the removal of Code sections on specific procedures for student complaints and misconduct (currently sections II and IV) to administrative procedures to allow for campus flexibility in procedural issues.
Yost’s motion carried
unanimously.
Agenda Item IX: [ACTION ITEM] Motion for Deferral - Resolution on
Journals, Databases, and Threats to Scholarly Publications: Andre De Tienne (Chair –
Library Affairs Committee, 4-5995, adetienn@iupui.edu).
De Tienne provided background
to the FC on his committee’s resolution “Motion Requesting that the IUPUI
Faculty Council Ask the University Faculty Council to Defer Its Vote on the
‘Resolution on Journals, Databases, and Threats to Scholarly Publications’
until the Fall of 2004.” Read the
background information by clicking here. De Tienne then moved that “any vote on the
‘Challenge to Scholarly Communication’ resolution at the UFC be deferred until
after the IUPUI Faculty Council has heard a presentation of the issues from the
IUPUI Library Affairs Committee and has been given the opportunity to vote on a
resolution that applies to the IUPUI campus, and after the UFC Library
Committee has rewritten the university-wide resolution on the basis of the
feedback received from all IU campuses.”
De Tienne’s motion carried
unanimously.
Agenda Item X: Resolution to Rescind 3/9/04 UFC Vote on Conflict of
Interest Policy: Christian Kloesel.
Kloesel presented the “Resolution to rescind the 3/9/2004 UFC Vote on
the New Conflicts of Interest Policy.”
The resolution resulted from the passage of a significant policy
revision by the UFC without proper faculty input and involvement in its
development. On the basis of these
procedural missteps and of the disregard of the concerns of some IUPUI faculty
about the policy revisions that went unanswered, the Faculty Affairs made their
motion. Friendly amendments were made
from the floor by Representative Bill Schneider and Dean of Faculties William
Plater. The resolution was slightly
reworked and the question called again.
The resolution (now titled “Resolution to Clarify the 3/9/04 UFC Vote on
the New Conflict of Interest in Research Policy” was passed as it reads below:
“Be in therefore resolved that, at its 4/27/04 meeting, the University Faculty Council affirm its commitment to present the Conflict of Interest in Research Policy to the Trustees only when matters related to teaching, professional service, and Conflict of Commitment can also be presented; further, the UFC be willing to entertain revisions to the recently approved Conflict of Interest in Research Policy until such time as it may be presented to the Trustees—…”
The amended resolution passed

Agenda Item XI: Proposed Campus Smoking Policy: Karen Whitney (Vice
Chancellor for Student Life & Diversity, 4-8990, whitney@iupui.edu).
Vice Chancellor Whitney
presented the [proposed] new campus smoking policy based on the work of the
implementation group convened based on the work of the Campus Smoking
Initiatives task force, chaired by Dr. Stephen Jay. Whitney encouraged dissemination of the
proposal and reminded faculty that feedback is welcomed. The proposed policy reads as follows:
“Proposed New Smoking Policy
Effective
July 1, 2004:
All buildings doorways and fully or partially enclosed
walkways connecting buildings will be smoke free.
Smoking
is prohibited on university owned property within 30 feet of building
entrances, exits, partially or fully enclosed walkways and ventilation systems.
Smoking is not permitted in university owned, leased
or operated licensed vehicles.
Advertising, sale, or promotion of tobacco products
and the sponsoring of campus events by tobacco companies or tobacco-promoting organizations is not permitted.
Enforcement
of this policy will depend upon all members of the campus community to comply
with and encourage fellow members of the campus community to comply with this
policy in order to ensure a healthy environment to work, study, and live. This policy will be incorporated into the Faculty
Handbook, the Staff Handbook, and the Student Code of Conduct. Complaints regarding violations of this policy should be referred to
the appropriate administrative office.”
Agenda Item XII: Campus
Non-Violence Policy: Ellen Poffenberger (Assistant Vice-Chancellor for Human
Resources, 4-8932, epoffenb@iupui.edu).
Assistant Vice Chancellor Poffenberger
disseminated the proposed implementation plan based on the work of the Campus
Non-Violence Task Force. The policy
disseminated detailed and addressed the following areas: the concept that all faculty, staff, and
students are granted equal coverage under the policy; existing federal/state
law and policy; the definition of threatening behavior; the definition of
violent behavior; reporting and investigating workplace violence; reporting and
jurisdiction lines (IUPUI police, appropriate campus offices, etc.); reporting
non-work-related violence; and non-disciplinary vs. disciplinary action. All IUPUI community members are encouraged to

Agenda Item XIII: [UPDATES]
“Doubling the Numbers” Task Forces: Jim Perry (Civic Engagement), Scott Evenbeck (Teaching & Learning), Mark Brenner/Janice Froehlich (Research, Scholarship, & Creative
Activity), and Karen Whitney (Diversity).
At a town hall meeting prior
to the FC session and at the FC session, itself, each chair presented draft
reports and commentary on observations in their respective areas, requesting
faculty feedback as it will be critical to this and resulting processes.

Research, Scholarship, & Creative Activity Chair Mark
Brenner discussed the concept of increasing and developing research at the university in the face of flagging
funding and limited space. He emphasized
the priority that his task force
must place on the concept of developing an appropriate infrastructure to
effectively support increased research,
which involves a myriad of considerations, not limited to but including
staffing issues. Send feedback on research, the necessary

Diversity
Chair Karen Whitney discussed the ways in which the work of her task force
would integrate with the work of the
other three, all the while examining ways in which issues of diversity in the
realms of hiring, retention, etc.

Agenda Item XIV: Chancellor’s Report: Charles Bantz (IUPUI Chancellor
/ IU Vice President).
Chancellor Bantz made a brief
report including the fact that that IU Trustees have approved a 4% increase in
tuition, which will impose certain hardships and require creative strategic and
long-range planning.
Agenda Item XV: President's
Report: Mary Fisher (IUPUI Faculty President & UFC Co-Secretary, 4-8027, mlfisher@iupui.edu).
Due to the time constraint placed
on the meeting by such an involved and lengthy agenda, Fisher abbreviated her
report and simply thanked everyone for attending this very important meeting,
then announced the April 13th AAUP Meeting in UL 1126 from 3:30-4:30
which will feature guest speaker Chancellor Bantz.
