  REQUIRED DAY OFF
  During the playing season, all countable <ARA> shall be prohibited during one calendar day per week, EXCEPT DURING PARTICIPATION IN ONE CONFERENCE AND POSTSEASON CHAMPIONSHIP AND NATIONAL INVITIATIONAL TOURNAMENTS, DURING PARTICIPATION IN NCAA CHAMPIONSHIPS, DURING FULL CALENDAR WEEKS FOR SPORTS PERMITTED TO CONDUCT PRE-SEASON PRACTICE, AND DURING FULL CALENDAR WEEKS WHEN INSTITUTION IS BETWEEN SEMESTERS.

ANNOUNCEMENT TO REPRESENTATIVES OF ATHLETICS INTERESTS
  Jaguars Supporters:

As a member of the National Collegiate Athletic Association (NCAA) and the Mid-Continent Conference, IUPUI is responsible for informing its student-athletes, faculty and staff, alumni and friends about NCAA and conference regulations.  Within those regulations, alumni and friends may be referred to as representatives of IUPUI athletic interests (Rep).  The following information is IUPUI Department of Intercollegiate Athletics guide to Compliance for Rep.

  IUPUI is very proud to have the loyal support of and continued interest in its athletics programs by our alumni and friends.
   
Definition of a Rep:
NCAA Bylaw 13.02.11 –
  A “representative of the institution’s athletics interests” is an individual who is known (or should have been known) by a member of the institution’s executive or athletics administration to:
 
  1. Have participated in or to be a member of an agency or organization promoting the institution’s intercollegiate athletics program;
  2. Have made financial contributions to the athletics department or to an athletics booster organization of that institution;
  3. Be assisting or to have been requested (by the athletics department staff) to assist in the recruitment of prospects;
  4. Be assisting or to have assisted in providing benefits to enrolled student-athletes or their families; or
  5. Have been involved otherwise in promoting the institution’s athletics program
   
NCAA Bylaw 13.02.11.1 states:
 
“Once an individual or entity is identified as such a Rep, the person or organization retains that identity indefinitely.”

Q

Is IUPUI responsible for the acts of its Reps and support groups such as the Jaguars Athletics Club and the Alumni?

A

Yes.  Reps are governed by the same NCAA, conference, and institutional regulations as those placed upon all institutional athletics staff members.

 

Definition of a Prospective Student-Athlete:
NCAA Bylaw 13.02.9
 
“A prospective student-athlete <prospect> is a student who has started classes for the ninth grade. In addition, a student who has not started classes for the ninth grade becomes a prospect if the institution provides such an individual (or the individual’s relatives or friends) any financial assistance or other benefits that the institution does not provide to prospective students generally."

Q

How long is a prospect considered a prospect?

A

A prospect remains a prospect even after signing a National Letter of Intent to attend an institution, and both the institution and the prospect continue to be governed by NCAA recruiting legislation until (a) the prospect reports for practice; (b) the registrar or director of admissions certifies that the prospect is officially registered and enrolled at the institution on the opening day of classes; or (c) the prospect attends a class or classes in any semester.
Definition of a Contact:
NCAA Bylaw 13.02.3
 
“A contact is any face-to-face encounter between a prospect or the prospect’s parents, relatives, or legal guardian(s) and an institutional staff member or Rep during which any dialogue occurs in excess of an exchange of a greeting.  Any such face-to-face encounter that is prearranged or that takes place on the grounds of the prospect’s educational institution or at the site of organized competition or practice involving the prospect or the prospect’s high school, preparatory school, two-year college, or all-star team shall be considered a contact, regardless of the conversation that occurs."

 Is the contact rule applicable to established family friends or neighbors?

A

 No.  However, it must be understood that such contacts are not made for recruiting purposes and are not initiated by the institution’s coaching staff members.  (NCAA Bylaw 13.1.2.2<d>)

Q

How may a Rep be involved in the recruitment process?

A

 * attend as many athletic contests as desired to evaluate talent (NCAA Bylaw 13.1.2.4) call, write, or send newspaper articles to the IUPUI coaching staff regarding outstanding student-athletes in his/her area
Q As a Rep, if I attend a prospect’s athletic event, may I talk to the prospect’s coach after the event?
A No.  A Rep may not contact the coach, the prospect or family members, the principal or counselor in an attempt to evaluate a prospect (NCAA Bylaw 13.1.2.4).
Q As a Rep, may I visit the prospect’s school to pick up transcripts or videotape/film to send to a college coach?
A No.  (NCAA Bylaw 13.1.2.4 <d>)
Q What if a Rep attends an athletic event and finds himself/herself sitting next to the parents of the prospect?
A Do not initiate the conversation with the relatives.  If conversation is initiated with the Rep, respond in a civil manner but do not discuss the IUPUI Athletics program with them.  If they ask questions about the program, remind them that the NCAA prohibits a Rep from discussing the program with them.  Encourage the family to contact the IUPUI Athletics Department directly.  (NCAA Bylaw 13.1.2.1.1)
Q May a prospect call a Rep?
A Yes.  A Rep may have a telephone conversation with a prospect only if the prospect initiates the call.  The telephone call may not be prearranged by an institutional staff member, and the Rep is not permitted to have a recruiting conversation with the prospect but may exhibit normal civility.  The Rep must refer any questions about the institution’s athletics program to the athletics department staff.  (NCAA Bylaws 13.1.3.5.1.1, 13.1.2.4 <a>)
Q During the recruitment of a prospect or prior to a prospect’s enrollment, may a Rep be involved directly or indirectly in making arrangements for a prospect, the propect’s relatives or friends to receive money, financial aid, or equivalent inducements regardless if similar financial aid, benefits or arrangements are available to prospective students in general, their relatives or friends?  (NCAA Bylaws 13.2.1, 13.16.1)
A No.  Other types of inducements that are prohibited include, but are not limited to:  (NCAA Bylaw 13.2.2)
 
  • the use of an automobile
  • signing or cosigning a note for a loan
  • special discounts or payment arrangements on loan
  • cash or tangible items (e.g., clothes, cars, jewelry, stereo equipment, even a soft drink
  • the promise of employment after college
  • an employment arrangement for a prospect’s relatives or friends
  • purchase of items or services from a prospect or the prospect’s family at inflated prices
  • free or reduced-cost housing arrangements
  • free or reduced-cost services or rentals of any type
  • the promise of financial aid for post-graduate education (NCAA Bylaw 13.16.1)
  • the promise to pay or arrange payment of transportation costs incurred by relatives or friends of prospect’s (NCAA Bylaw 13.6.2.8)
  • the use of IUPUI athletics equipment (e.g., for a high school all-star game)
  • sponsorship of or arrangement for an awards banquet for high school, prep school, or two-year college athletics by an institution, Reps, or its alumni groups or booster clubs.
Q May Reps entertain relatives and friends of a prospect at any site off-campus?
A No.  (NCAA Bylaw 13.01.5)
Q May a Rep make contact with a prospect and/or her/his parent(s) or legal guardian(s) during an official or unofficial visit to campus?
A No.  (NCAA Bylaw 13.5.1.1)
Q Is it permissible for a Rep to be involved in the on-campus entertainment of a prospect and/or his or her parent(s) or legal guardian(s) during an official or unofficial visit?
A No.  (NCAA Bylaws 13.5.1.1, 13.7.5.1, 13.8.2.1)
Q Is it permissible for a Rep to pay costs incurred by an athletics talent scout in studying or recruiting a prospect?
A No.  (NCAA Bylaw 13.1.2.8)
Q Is it permissible for a Rep to employ or arrange for the employment of a prospect before the completion of his/her senior year in high school?
A No.  However, NCAA Bylaw 13.2.4.3 permits an institution to arrange employment for a prospect that begins after the prospect’s senior year in high school.
Q Is it permissible for a Rep to pay admission to IUPUI away contests for prospect’s, their relatives, or friends?
A No.  (NCAA Bylaw 13.2.1)
Q Is it permissible for a Rep to pay for prospect’s expenses to attend institution’s sports camp(s)?
A No.  (NCAA Bylaw 13.13.1.5.2)
Q May a Rep provide funding to benefit a high school athletics program located in the community in which the Rep resides?
A Yes.  Provided the Rep acts independently of the institution, funds are distributed through channels established by the high school or the organization conducting the fund-raising activity, and the funds are not earmarked directly for a specific prospect.  (NCAA Bylaw 13.16.1.2)
Q What if a Rep hears that an athlete at another institution is unhappy and would like to transfer to IUPUI?
A A Rep may not contact an enrolled student-athlete at another institution for the purpose of encouraging transfer to IUPUI and participation in the athletics program.  The Rep may give the information to the appropriate IUPUI coaching staff.  (NCAA Bylaw 13.1.2)
Q How may faculty members be involved in the recruiting process of a prospect?
A Faculty members are not permitted to recruit off-campus except for a meal at the home of a faculty member during the prospect’s official visit.  Faculty may have on-campus contact with prospect’s.  They may write prospect’s.  At the request of a coach, faculty may telephone prospect’s in accordance with applicable one per week limitation and the dates an institution may place telephone calls to prospect’s.  (NCAA Bylaws 13.7.5.7.1, 13.1.3)

NCAA RULES REGARDING CONTACTS WITH CURRENTLY ENROLLED STUDENT-ATHLETES
EXTRA BENEFITS
Definition of Extra Benefit:
NCAA Bylaw 16.02.3
 
“An extra benefit is any special arrangement by an institutional employee or a Rep to provide a student- athlete or the student-athlete’s relative or friend a benefit not expressly authorized by NCAA legislation. Receipt of a benefit by student-athletes or their relatives or friends is not a violation of NCAA legislation if it is demonstrated that the same benefit is generally available to the institution’s students or their relatives or friends or to a particular segment of the student body (e.g., foreign students, minority students) determined on a basis unrelated to athletics ability."
 
Examples of extra benefits include, but are not limited to:  (NCAA Bylaw 16.12.2.2
  • use of an automobile
  • special discounts or payment arrangements or credit on a purchase such as airline tickets. clothing, or a service such as laundry or dry cleaning
  • use of a Rep’s telephone or credit card for personal calls without charge or at a reduced cost
  • services from commercial agencies without charge or at reduced rate (e.g., movie tickets from a movie theater, use of a car from a car dealer) or free or reduced-cost admission to professional athletics contests from professional sports organizations, unless such services also are available to the general student body or complimentary tickets are being provided by the department or rep during a team’s away-from-home contest (NCAA Bylaw 16.7.1.1)
  • loan of money
  • guarantee of bond
  • signing or cosigning a note with an outside agency to arrange a loan

Q

Is it permissible for a Rep to expend funds to entertain student-athletes and friends?

A

No.  (NCAA Bylaw 16.6.1)  Entertainment of student-athletes’ relatives and friends is expressly prohibited unless noted by a permissible exception.  No exception would allow a Rep to directly pay entertainment expenses for student-athletes. 

Q

Is it permissible for a Rep to provide employment for student-athletes?

A

Yes.  However, compensation must be paid only for work actually performed and at a rate commensurate with the going rate in that locality for service of like character.  (NCAA Bylaw 12.4.1)

Q

Is it permissible for a Rep to employ or use the name or picture of a student-athlete to directly advertise, recommend or promote sales or use of a commercial product or service of any kind?

A

No.  The use of a student-athlete’s name or picture in this manner affects the athlete’s amateur status and eligibility to compete in intercollegiate athletics. (NCAA Bylaw 12.5.2)

Q

Is it permissible for a Rep to provide gifts or awards to a student-athlete for his or her athletics performance?

A

No.  All awards must conform to NCAA awards legislation and must be approved by the institution.  (NCAA Bylaw 16.1.4)

Q

Is it permissible for a Rep finance a banquet for an IUPUI athletics team?

A

Yes.  One time per year an institution’s athletics booster club may finance an intercollegiate team’s transportation expenses to a recognition banquet, provided all expenses are paid through the institution’s athletics department, the location of the event is not more than 100 miles from the campus and no tangible award is provided to members of the team.  (NCAA Bylaw 16.1.6.1)

Q

Is it permissible for a Rep to provide an honorarium to a student-athlete for a speaking engagement?

A

No.  Student-athletes may receive only necessary travel expenses when speaking to educational or charitable groups.  (NCAA Bylaw 16.11.1.7)

Q

Is it permissible for a Rep to provide student-athletes with professional services (for which a fee would normally charged) for personal reasons?

A

No.  (NCAA Bylaw 16.12.2.2.1)

Q

Who may have a student-athlete or team over to her/his home for a meal?

A

A student-athlete or a team may receive an occasional family home meal from an IUPUI staff member or Rep provided: (NCAA Bylaw 16.12.1.5)

 

  1. the meal is in an individual’s home, not a restaurant, and may be catered
  2. meals must be restricted to infrequent and special occasions
  3. IUPUI staff members may provide transportation to student-athletes to attend the meal.

Q

When an IUPUI team is competing in a city with an IUPUI Alumni Club, is it permissible for the alumni club to provide dinner for the team?

A

Yes.  (NCAA Bylaw 16.7.1)
