IUPUI FOOD SERVICE
During the holiday vacation, important developments occurred that will affect our beginning of semester plans for campus food service. A Marion County judge has issued an injunction that affects food service operations in University College and Cavanaugh Hall, and blocks completion of construction to renovate food service operations in these buildings.
The injunction was issued December 23, 2002, by Marion County Superior Court Judge David Dreyer. University Development Group, which owns University Place Hotel, filed the lawsuit seeking an injunction concerning food service at IUPUI. The University Development Group lawsuit argued that IUPUI violated the terms of a 1986 agreement that granted it certain rights to provide food service on a portion of the campus. University Development Group asked the court to prohibit the campus from operating or developing food service facilities at Inlow Hall, University College, Cavanaugh Hall and the Campus Center, a yet to be constructed facility. The injunction issued by Judge Dryer affects only University College and Cavanaugh Hall.
According to the order, the injunction will remain in place until IUPUI follows a set of steps under the 1986 agreement between the campus and University Development Group.
IUPUI maintains that it fully complied with the terms of the 1986 agreement. IUPUI is considering the full range of legal options, including an appeal of the injunction.
