NIH Guidelines for Transgenic Animals
The IUPUI IBC to the Office of Biotechnology Activities, NIH, submitted the following questions:

IBC Question 1
For transgenic animals, particularly mice and transgenic meaning "expressing a gene" and not a knock-out; if the investigator has the animals made for them or purchases these animals, some investigators have felt this means the studies are exempt. We have interpreted the guidelines such that they are not exempt and fall, at a minimum, at the BL-1 level. Can you clarify?
NIH Response
In response to your first question, the language in the NIH Guidelines specifically mentions only purchase and transfer of transgenics being exempt (assuming BL-1). The use of the animal is not exempt from the NIH Guidelines. The use is an area where the IBC at a minimum has to be consulted and the experiments with the animal have to be done at BL-1 or above, as appropriate.

IBC Question 2
We have been treating knock-out mice as BL-1 since the germ line is altered and the way they are made requires recombinant techniques. However, once they are made a number of investigators are arguing that they should be exempt. I fall into the group that feels they should be BL-1 or higher, but would like your input.
NIH Response
In response to question number 2, I agree with your assessment that the NIH Guidelines do not distinguish between the generation of the knock-out and its use. Therefore under Section III-D-4 of the NIH Guidelines, it seems that BL-1 (or higher, if appropriate) is required. In general, the NIH Guidelines serve to provide guidance on minimal levels of containment. It is within the purview of the IBC to increase the containment level for any type of research that is defined in the NIH Guidelines.
